ParTrek terms of use

1. Who we are and what these terms cover

ParTrek is a golf score and practice app for iPhone, published by Corneil Efoma ("we", "us", "our"). These Terms of Use are an agreement between you and us, not Apple. They govern your use of the ParTrek app and any paid features in it, and by downloading or using ParTrek you agree to them. Where required, these terms incorporate Apple's minimum terms for licensed applications, and the app is also licensed under Apple's Standard Licensed Application End User License Agreement.

2. Your licence to use ParTrek

We grant you a personal, non-exclusive, non-transferable licence to install and use ParTrek on Apple devices that you own or control, for your own personal, non-commercial use, as permitted by the App Store terms. You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the app, except where the law expressly allows it.

3. Subscriptions, free trials and billing

• Price: ParTrek Pro is an auto-renewing subscription at £1.99 per month or £12.99 per year (or the local equivalent shown by Apple).
• Free trial: new subscribers get 14 days free, where offered and subject to eligibility. Apple shows the offer, its length and the price before you confirm, and not every user or plan is eligible. If you don't cancel at least 24 hours before the trial ends, your subscription starts automatically and you're charged the plan price.
• Auto-renewal: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple account is charged for renewal within 24 hours before the period ends.
• Cancelling: go to iPhone Settings > your name > Subscriptions, or your App Store account settings. Deleting the app doesn't cancel a subscription.
• Payments and refunds: these are handled entirely by Apple. Refund requests go through Apple at reportaproblem.apple.com, and we never see your payment details.
• Price changes: if a price changes, Apple will notify you in advance and, where required, ask you to agree before you're charged the new price. Any unused part of a free trial is forfeited when you start a paid subscription.

4. Your data

Your golf records, journal entries and the media you select are stored locally on your device, and backing them up or sharing them is under your control. Photos and videos aren't copied into backup files. Uninstalling removes local records but not shared copies, exported backups or records held by providers, and it doesn't cancel subscriptions.

RevenueCat processes a random app user ID, purchase history, subscription status, device and OS information, and IP address to manage and validate subscriptions and restore purchases. Apple handles all payments, and ParTrek never sees card or payment details. 5. Other scorecard apps

Companion mode lets you journal rounds you score in another app. Any score you type in from another app is your own entry, and ParTrek doesn't connect to or exchange data with that app. ParTrek isn't affiliated with or endorsed by VPAR, Squabbit, The Grint, SmoothSwing or any other app you name, and their names belong to their owners.

6. Acceptable use

You agree not to use ParTrek unlawfully, to interfere with or disrupt the app or its distribution, or to misrepresent the app or its content as your own. You must comply with any applicable third-party terms (for example, your mobile carrier's terms) when using the app.

7. Changes to the app and these terms

We may update, change or discontinue features of ParTrek over time. If we make material changes to these terms, we'll update this page and the "Last updated" date above, and note the change in the App Store release notes. Continuing to use the app after a change means you accept the updated terms.

8. Disclaimer of warranties

ParTrek is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee that the app will be uninterrupted or error-free, or that scores, statistics or insights will be accurate. Nothing in these terms affects the statutory rights you have as a consumer that can't be excluded by law.

9. Limitation of liability

To the fullest extent permitted by law, we aren't liable for any indirect, incidental or consequential loss arising from your use of ParTrek, including loss of data. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim arose. Nothing in these terms limits liability that can't be limited by law, including liability for fraud, or for death or personal injury caused by negligence.

10. Apple's role

These terms are between you and us. Apple has no obligation to provide maintenance or support for ParTrek and isn't responsible for addressing claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If ParTrek fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the app.

11. Termination

These terms apply for as long as you use ParTrek. They end automatically if you breach them, and you can end them at any time by deleting the app. Remember to cancel any active subscription separately through your Apple account.

12. Governing law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales, without affecting mandatory consumer protections in your country of residence.
